ACCEPTABLE USER POLICY

ASP Web Hosting's Acceptable User Policy is intended to provide our customers and users with an understanding of what we ( ASP-Web-Hosting.net ) expect of them while they make use of our services. All users must comply with this policy and our Terms & Conditions or their accounts may be deactivated. Any use of ASP Web Hosting's services constitutes acceptance and total agreement to both this Acceptable User Policy and our Terms & Conditions.

1. Content Restrictions

1.1 All services provided by ASP Web Hosting's Networks may be used for lawful purposes only. Any Transmission, storage, or presentation of any information, data, or material in violation of any law are strictly prohibited.

1.2 Pornography, nudity or any other sexually orientated material is strictly prohibited in all forms including links to other web sites etc.

1.3 ASP Web Hosting support and actively promote the uncensored flow of information over the internet under normal circumstances. We do not exercise editorial control over any web site accessible via our services. However in accordance with our terms and conditions, we prohibit what we deem to be unacceptable sites on our networks. Unacceptable sites include warez sites, illegal mp3 sites, hacking programs or any sites promoting any form of pirated goods or services. Any such sites shall be removed immediately as described in our terms and conditions. ASP Web Hosting is the sole arbiter on what constitutes unacceptable.

1.4 Your Responsibility for Content & Conduct
You are responsible for any content that you post or transmit on or through our Service. You will not use the Service to distribute, link to, or solicit content that:

• is unlawful, harmful to minors, threatening, harassing, abusive, defamatory, vulgar, gratuitously violent, obscene, pornographic, libellous, or racially, ethnically or otherwise offensive;
• includes personally identifiable information about children;
• infringes someone else's intellectual property or other rights;
• advocates or solicits violence or other criminal conduct;
• violates any law, regulation, or contract;
• promotes participation in multi-level or pyramid marketing initiatives;
• constitutes a raffle, sweepstakes, lottery, or any other form of gambling;
• specifically advertises firearms or ammunition contains software viruses or any other computer code, files, or programs that are designed or intended to disrupt, damage, or limit the functioning of any software, hardware, or telecommunications equipment;
• contains pirated or illegal software or crack serial numbers that are designed to circumvent proper software licensing and registration;

2. ASP-webhosting's SPAM Policy

2.1 ASP Web Hosting must not be the source or any intermediary address involved in any transmission of SPAM, mail bombs or any other unsolicited mail

2.2 ASP Web Hosting considers SPAM to be any unsolicited communication in mediums on our networks such as newsgroups, forums or eMails.

2.3 Anyone not obeying our SPAM policy will have their account deactivated without refund or appeal. ASP Web Hosting is sole arbiter as to what constitutes SPAM or unsolicited contact.

3. Abuse of servers

3.1 Any attempt to undermine any ASP Web Hosting web site, another ASP Web Hosting customer site or the ASP Web Hosting servers is strictly prohibited and will result in an immediate terminination of all services without refund or recourse. ASP Web Hosting is sole arbiter as to what defines server abuse.

3.2 All clients are allowed to install CGI applications freely. But any application that unreasonably affects the normal server operation may be disabled, subject to a necessary communication with the client. In extreme cases where a script is causing harm to ASP Web Hosting networks , ASP Web Hosting reserves the right to disable the script before informing the client. This will only happen in extreme circumstances.

4. Indemnity

You agree to indemnify, defend and hold harmless ASP Web Hosting, its affiliates, directors, employees and agents from any and all third party claims, liability, damages and/or costs (including, but not limited to, legal fees) arising from your use of our services, your violation of the Acceptable User Policy or your infringement, or infringement by any other user of your account, of any intellectual property or other right of any person or entity.

5. Privacy

ASP Web Hosting respects user privacy. ASP Web Hosting does not disclose rent or sell your eMail address or any other information we may receive to any third party. ASP Web Hosting may disclose individual account or user information in cases when we have reason to believe that disclosing this information is necessary to identify, contact or bring legal action against someone who may be violating the law or may be causing injury to or interference with ( either intentionally or unintentionally ) ASP Web Hosting rights or property. ASP Web Hosting may disclose or access account information when we believe in good faith that the law requires it and for administrative and other purposes that we deem necessary to maintain, service, and improve our products and services. Please note that with each page visited, your IP address is recorded, in the event that you need to be banned from the Service or your ISP contacted.

6. Reserved Rights

ASP Web Hosting reserve the right to change or modify this Acceptable User Policy at any time. All users will be notified of such changes as and when it is practical to do so.

7. Abuse of Staff and Networks

Anyone found to use rude abusive or violent language to any ASP Web Hosting staff member will be warned once. Repeated abusive conduct will result in termination of services without refund.
